1. General Provisions
1.1. This Service Agreement (hereinafter referred to as the “Agreement”) constitutes a public offer by Inferno Construction, operating under the domain, hereinafter referred to as the “Contractor,” to any individual or legal entity (hereinafter referred to as the “Customer”) to enter into a service contract under the terms and conditions described below.
1.2. In accordance with Article 66(1) of the Civil Code of Poland and other applicable legislation, this document is a public offer. Full and unconditional acceptance (hereinafter — “Acceptance”) of this offer is deemed to occur when the Customer submits an order, fills out a form on the website, or otherwise expresses consent to receive services from the Contractor.
1.3. From the moment of Acceptance, the Customer is deemed to have read, understood, and agreed to all the terms of this Agreement.
2. Subject of the Agreement
2.1. The Contractor provides professional construction and related consulting services, including but not limited to: project design, site preparation, renovation, engineering consultation, and other construction services (hereinafter — “Services”), as described on the website.
2.2. The scope and specific terms of the Services are determined individually for each Customer, based on a request submitted through the website or other communication channels.
3. Procedure for Service Provision
3.1. Services are provided remotely or on-site, depending on the nature of the work, after mutual agreement between the Contractor and the Customer.
3.2. To initiate service delivery, the Customer must:
Submit a request via the website contact form, email, or phone;
Provide necessary information regarding project details and requirements;
Confirm acceptance of a service proposal or quote provided by the Contractor.
3.3. The Contractor undertakes to perform the Services in accordance with the agreed terms, timelines, and technical specifications.
3.4. The Customer shall provide access to all necessary data, documents, or facilities required for the proper execution of the Services.
4. Service Fees and Payment Procedure
4.1. The cost of Services is determined based on the Contractor’s current price list or individual quotation agreed upon with the Customer.
4.2. Payment shall be made via bank transfer, electronic payment system, or other methods indicated on the website.
4.3. Unless otherwise specified in the quotation or contract, payment shall be made in Polish złoty (PLN) or euros (EUR).
4.4. The Contractor reserves the right to request full or partial prepayment before commencing work.
4.5. Services are considered rendered upon completion of the agreed scope of work and acceptance by the Customer.
5. Rights and Obligations of the Parties
5.1. Contractor’s Obligations:
To provide Services of appropriate quality and within the agreed timeframe;
To ensure confidentiality of Customer data and project details;
To inform the Customer of any circumstances that may affect the delivery of Services.
5.2. Contractor’s Rights:
To refuse or suspend Services if the Customer violates the terms of this Agreement or fails to provide necessary information or payment;
To engage third parties in the performance of Services, remaining responsible for their actions.
5.3. Customer’s Obligations:
To provide accurate and complete information necessary for service delivery;
To make timely payments as agreed;
To cooperate with the Contractor in good faith and provide access to required resources or facilities.
5.4. Customer’s Rights:
To receive Services that meet the agreed quality and specifications;
To request clarification on the scope, price, and progress of the Services.
6. Liability of the Parties
6.1. The Parties are liable for non-performance or improper performance of obligations under this Agreement in accordance with applicable law.
6.2. The Contractor shall not be liable for indirect, incidental, or consequential damages, including loss of profit, arising from the use or inability to use the Services.
6.3. The Contractor shall not be responsible for delays caused by force majeure circumstances, including but not limited to natural disasters, strikes, government restrictions, or other events beyond reasonable control.
7. Dispute Resolution Procedure
7.1. All disputes and disagreements arising from this Agreement shall be resolved through negotiation between the Parties.
7.2. If a dispute cannot be resolved amicably, it shall be submitted to the competent court in Poland, in accordance with Polish law.
8. Confidentiality and Personal Data Protection
8.1. The Contractor collects and processes personal data in accordance with the Privacy Policy, published on.
8.2. The Contractor ensures the confidentiality and protection of all Customer information obtained during service delivery and will not disclose it to third parties without prior consent, except as required by law.
8.3. By accepting this Agreement, the Customer grants consent to the processing of personal data for the purposes of communication, service delivery, and compliance with applicable regulations.
9. Other Provisions
9.1. This Agreement constitutes a legally binding document and applies to all Customers who have accepted the offer.
9.2. The Contractor reserves the right to amend the terms of this Agreement unilaterally. Updated versions will be published on the website and shall take effect immediately upon posting.
9.3. The invalidity of any provision of this Agreement shall not affect the validity of the remaining provisions.
9.4. All matters not covered herein shall be governed by the applicable laws of Poland.
